    Japanmom- We lived in Hawaii when he signed up. And we now live in Florida and he got a Florida drivers license. There is no state tax in Florida so it would help him out on the paycheck.

    Navymom-he does not need to change his home of record but his home of residency.  He will need to fill out form  DD Form 2058.  Legal/PSD can help him.  He needs to tell them that he plans to retire in Fl....not because it is a tax break.  Hope this helps.

    navymom - He can NEVER change his Home of Record, but yes, he wants to change his State of Residence to Florida if his state requires him to pays taxes.  It's a huge savings.  I did mine when I was at Corry in 1978 and remained a Florida residence until I retired.  

    I wrote the entire process on this thread.  Goto about page 84, on March 24 2011 at 10:48pm, I described in detail what you do, and how to do it.  Frankly, I think any sailor is a fool not to do it, IF they pay taxes in the state where they are currently.

    Thank you very much Craig. I have sent all the info to my son in Pensacola. My other son  has Oregon as his state of record as we were living there when he joined. So he is good to go.

    Glass dog- I think my son is now graduating 7/29 as CTT. He was supposed to graduate 7/21 and we had already booked flights, hotels, etc. Yesterday got a call that they changed the date. How frustrating, not sure if we can change tickets. Is your son CTT?

    Went to see the NAVY band last nite in Rochester NY (my home) at Lake Ontario Park  They were playing as part of NAVY Week  What a great time!   It made me so proud to see those great white uniforms in the crowd.  Something we dont get to see a lot of here in Upstate NY.  Talked with several of the sailors and they sounded like they were having a great time here   Made me even prouder (if that could be) to be a NAVY Mom!    Today watching the skies for a glimpse of the Blue Angels as they practice for this weekends show

    Your Home of Record truly means nothing.  All it means is when you get out, they must send you back to that location.  That is the only thing.  The real important one is, like I said, the State of Residence.

    My sailor is home! Hubby surprised me for my birthday & as we were having dinner, in he walked in uniform & w/flowers.  Such a wonderful week! He just graduated CTT C school last Friday & starts a 5-week shipboard procedure(?) class on Monday! He hasn't received verbal orders yet...there was a rumor of Japan but we'll see.

    I have a question about shipboard training. Is that done in the classroom or do they actually go on board a ship? This may seem like a silly question but I am new to all this. And for a CTT that is only 4 year, does anyone know how long the class is? My CTT graduates A School August 12- and then will be put on hold waiting to go to class on shipboard and I am not sure what that entails.

    NavyMom4J...my son said the shipboard training is at Corry on simulators from what I understand. My son starts on Monday and I believe he said it is for 5 weeks.

    Thanks rorysmom - I was unsure since he graduates A school- i don't think he does C school- so wondered if it was the same amount of time for shipboard.

    NavyMom. My son is a 6year he did C school which is the maintenance part. He did say he would be in the class with the 4-year CTTs. He only had a week between C school and starting this new class which was nice.

    My son had his first test today in his CTM class. Scored a 97.5 we are very proud of him. Said he only missed 1 question. He is aiming to be top of the class.

    Wow Navymom3 that is wonderful! My son just graduated A school and starts C school Monday. He said he is happy to be free of all the extra duty he has had between classes.lol

    Navymom3- that is so awesome. My son said they get mandatory study if they fall below 90%. Navy expects Excellence! Keeps our sailors at the top! My son is thankfully staying above 90% - so is very happy! His girlfriend is now visiting him for a week!!!  Wish I could be too!

    Wow, sounds like our Sailors are doing great!  My son scored a 93 on Monday, 100 on Wed. and another 100 on Friday in his CTR class.  He was 2nd in his class and is also aiming to be #1!!!  Go Sailors!!!!  Hooyah!  So proud of him!

    ctmom - Today will be the 1st day to see if I can contact the guy.  I took off of work on Thurs and Friday because my website had a get together here in Colorado.  Last year it was San Diego, next year is Boston.  It was pretty cool!

    I read your post on changing your State Of Legal Residency (page 84) for tax purposes and I totally agree. Why should sailors get reamed by the state (Calif.) they joined up in if they may never return there until maybe after they finish their hitch. Our state has some of the highest in the nation. I do have some specific questions. I saw this on Military.com regarding this issue.

    "However, the military is required by regulation to ensure that military members are not changing their "legal residence" for the sole purpose of obtaining a tax advantage. Therefore, when changing your "legal residence," military officials at the legal office (or finance office) may require some degree of proof that you consider the new state to be your "permament home." So does the legal dept.(or finance office) give sailors the 3rd degree if they file for different status or do they even care? Once one changes their state of legal residence does that mean all of their personal business correspondence (bank, credit card statements etc.) must go to that address as oppsed to their Home of Record?     CRF230dad-My husband is WA state resident.  We changed his residency when we lived there.  We changed for a couple reasons.  1. state taxes and 2. voting.  We have not always lived there and all of our bank accounts and bills follow us from state to state but his residency will not change unless he chooses to change it.  Drivers License-I am not sure about Florida but WA issues a military drivers license that does not expire until he gets out of the military.  Getting his license there also registered him to vote in WA and now he doesn't have to worry about his license expiring.  You might want to look and see FL has something similar.

    Lady - Her orders will not be for a PCS move to Pensacola.  She is only there for temporary duty (TEMDU) , or, temporary duty under instruction. (TEMDUINS).  So she is not entitled to moving her HHG to Pensacola.  If she was there for more than 20 weeks of training, then she would fall under a different rule and she should be allowed to move her stuff there.  

    This is per JFTR U5345-C.1 titled "U5345  TRANSPORTATION UNDER VARIOUS SITUATION"  

    Here is the legal mumbo jumbo about the HHG stuff...  I bet I will have your brain spinning after reading this....

    CRF23 - That's a bunch of questions at once.  I will have to break it down to see if I can explain them.  My answers will be in italic and bold.

    I think your reading way more into this.  Where do you see that you must go to the legal office to file the form?  http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd2058.pdf

    You don't....  What you will see is that the easiest way to prove your a legal residence is "(5) preparing a new last will and testament which indicates your new State of legal residence/domicile".  The base legal office isn't the only place to get a will.  Heck if you go to LegalZoom.com or any number of place to make a will.  Yes, the base office is free, and what do they care if you make a will, that's your business, not theirs.  Why would anyone say "I'm here to make a will so I can change my residence".  They wouldn't, unless they were really, really naive.   So once you get the will, then download the DD-2058 and turn it into your PS for processing.

    Do they go there now?  You have the right to change your addresses and anytime.  You can't even put your own mail on hold at the post office if you plan to be gone over 30 days. You will change your address in the military about 30 times if you make it a career.

    Wow, this will be hard to explain, but there is a rule call the "Three State Rule" that you can't violate. You can only have two states.  So you have

    • (1) Your drivers license
    • (2) Your car license plates (& registration),
    • (3) Your duty station. 

    You can mix and match them all you want, as long as it is two states.  But what is not allowed is if you have a Driver License from Oregon, your license plates from California, and your duty station being Florida.  Why? Because now three states are involved.   So you need to move one of them to make it only two states.  This is all part of the Soldier's and Sailors Relief Act which protects the serviceman's rights.  Does that make sense to you?  Not the rule, but the explanation?

     

    If you change barracks to a different base or a different state does it matter if your still on record for where you did A school (FL)?

    If that's your residence what difference does it make?  Think of the barrack as an apartment.  How many people move apartments?  You move all the time.  That is your house, much like an apartment to a civilian or a military member who collect BAH.


    I know you said making a will is the best/simplest way to establish residency but is that all that's required?

    Read the rule, it says:  (You only need one of them)

    "Your intent to make the new State your permanent home may be indicated by certain actions such as:

    • (1) registering to vote;
    • (2) purchasing residential property or an unimproved residential lot;
    • (3) titling and registering yourautomobile(s);
    • (4) notifying the State of your previous legal residence/domicile of the change in your State of legalresidence/domicile; and
    • (5) preparing a new last will and testament which indicates your new State of legal residence/domicile.

     

    In Calif.     I had a Navy Federal account which is in Virginia.  I claimed the interest on my federal tax, but since I changed my residence from Colorado to Florida, and since Florida doesn't have a income tax, then I didn't have to do anything.  

    Bottomline, in the Navy we have a term called "KISS".  Which means Keep It Simple, Stupid".  So just follow the rules, and do what the rules say.  No more, no less.  Per the taxes, talk to your tax guy to verify this info.

    My son CTR is scheduled to graduate July 29th   We thought he was coming home for 2 weeks having to report to Ft Meade on Aug 14th  However he called last nite and said that everyone's orders are messed up   Their orders say they are graduating July 15th and to report Aug 4th   He said only his sponsor can help wit this but he hasn't heard from his sponsor yet.   Can someone explain how this works?  How do you get a sponsor?   Its very confusing and frustrating

    Sandy - "A" school doesn't count.  It's not a PCS duty station.

     

    Angie - The sponsor can't do anything.  They are just newbies just like your son that truly don't know the way things work....

    What he needs to do is contact PSD and have they do an ORDMOD (order modification).  It's a simple process, and it happens all the time.  Have him figure out what he wants to do, ie have his car, ship his HHG, Leave, etc).  Then have him go to the PS's and tell them he want a NLT (Report no Later Than) date of mm dd yyyy (for example 08 23 2011).  He needs to do this as soon as he can, because they may have to send a message to the detailer for approval to change it.  But like I said, it's a simple process.

    I have another question for Craig (or anyone who knows) concerning moves.  Our  E5 son is stationed in Hawaii receiving BAH.  He has new orders, but before he reports he will go to C-School.  Does he continue to receive Hawaii BAH rates, no BAH, or his new destination BAH????????  Thanks

    Craig- My SR has been at BC since 7/7. He just called me today to ask for a few of his HS friends phone numbers. He said they did not want the HS office number just the numbers of his friends. I think it's because of the security clearances not for any HS grad verification like they told him. How long does it generally take for the clearances to be finished? His PIR is 9/1 and will be at Correy station as a CTR.

    boilermom - my son is at Corry at a CTR - he PIR'd April 8.  Will grad A school on Aug 5.  He still does not have his clearance finished - has a provisional as most of the people in his program do.  He had to give even more information to the FBI a couple weeks after he got to Florida.  It is a long process - they say they will get their clearances at their first duty stations.

    Hey all, don't get this wrong...  but I'm a member just like you guys.  If you could, please ask your questions to the entire team (members) and not just to me.  There is a lot of moms here that have awesome knowledge and experience.  What I don't want is being the single point when there are others that have the knowledge and skills to answer the questions.

    I truly don't mind giving my inputs, but it's only fair to allow all members to speak up and share what they know.  We are a team!  I really want a strong and cohesive group.    

    You guys know me, I always try to back up my information with official web links that point to specific instructions.  But you'd be amaze the number of times people have shown me stuff that was really informative and cool.  So I want people to all join in the conversation.

    Secondly, I will have your back, and you know I don't sugarcoat stuff.  Heck, I'm a vet, I speak the truth with no artificial sweeteners ~ha.    Thus, why I was banned from the Pensacola group (along with clockard).  Both clockard and I are the "bad kids".  But guess what, we don't take crap from anyone.  Bottomline is when you ask for information, I try to give you the best answers.  I'm not always 100% correct. 

    I really just wanted to vent, and let you guys know that my job in the Navy was building teams.  I want to build our group up to be a team too.  

    Lastly, you guys know that I joke around..     Clockard and Craig~I like this group so much better than the Pensacola group. A couple of them got their panties in a bunch a while back when I said that Corry was different than NAS.  I felt the moms of sailors just arriving at Corry were not getting accurate info. there are some really nice people on the Pensacola group but it is not geared toward Corry.

    My son got his list of places he can put on his dream sheet today. He was wondering how Korea is if anyone has any info. They have to number overseas, stateside and sea duty from 1-3. then 3 choices under each one. He would like to go overseas but there was only Hawaii, Korea and Guam. I have been to Guam and don't think he would like it. The Island is smaller than the one we lived on in Hawaii.

    Navymom - Yea, that was the cool part, only the Navy allowed them.  However starting Jan 1, 1986 all beards were required to be shave.  It was actually really funny seeing people on Dec 31st, then not knowing them Jan 1st.

    Navymom - Korea is actually awesome.  I tried my whole Navy career to get PCS there or Augsburg Germany (yea, I should have joined the Army).  All I could ever get is TAD order, or riding ships there.  He would more than likely get stationed in Seoul.  They have a military recreation center hotel there call the Dragon Hill.  It's a 5 star hotel, at a cheap military price.

    Going on a trip to the DMZ is really, really cool.  That is where the largest flag in the world is located.  The shear weight of the flag almost make it not be able to hang.  It's a North Korean flag.  

    We still hate North Korea.  In fact, the only commisioned U.S. Navy ship is still being held hostage there.  What's cool is it is a CT ship.  The whole crew basically were CT's

    So, I think he'd be a fool not to go.  Those are awesome orders.  The only thing I don't like about Korea is after the 1988 Olympics, the economy start to rise.  You once could buy Nike, Adidas..ect for $1, now it's the same price as in the U.S.....  So the bargains are long gone.
