My husband is in "A School" in South Carolina and I'm hoping to find out today when He can come get me and our daughter and move us up there with him.

1) My question is, would we be responsible for our apartment now if we can't find someone to sublease?. We told our landlord two weeks before he left for boot camp that we should be out by February. She just told me that i was responsible for finding someone to take over the lease and if not my husband and I would have to pay the rent until we find someone to take it over.

2) Why would she have to keep a copy of our marriage license and do we have to give it to her or just let her see it?

3) He is a nuke and he said he wasnt suppose to show anyone his orders for school but she's demanding to see those as well.. But I know she needs to see it to let us out of the lease.
What would be the best way to handle all this and what should I do.?

I'm new at all this and with her and my daughter I'm just really overwhelmed.

He should be able to show his orders saying he's stationed here in Charleston... those shouldn't be classified or anything like that. In fact, Ryan's going to give me a copy of his so I can get tri-county tuition for the classes I'm taking right now in town. She will probably need to see those orders if she's going to let you get out of a lease earlier than the contract spelled out. (ugh don't you just hate contracts when you're in the military...)

She should NOT need to keep a copy of your marriage license for her records... that just sounds silly to me. I guess I could kind of see where she'd like to maybe SEE the license so she knows he is actually your husband, and it is HIS orders that requires you BOTH to leave and for the lease contract to be broken prematurely. I mean if y'all were just friends or something I'd expect her to "make" you stay or pay the rent until the contract expires - but if you can prove he's your husband and his orders (from the GOVERNMENT, for pete's sake, haha) are causing you both to leave, then do that. She can't really argue with that.

How much would it be to break the contract? Sometimes apartments have a $200 fine for breaking a contract - if yours has that, it MIGHT be a good idea, if possible, to just suck it up and pay the $200 so you don't have to deal with it anymore. But if it's the setup where you have to find a subleaser to finish your contract out... I don't know. His military orders should take care of things... but just to be safe, I'd list your apartment on craigslist or something. Ryan had to do that (we weren't married at the time and he had to leave his apartment before the lease ended) - he listed his room on craigslist and offered to split rent with the new subleaser until the contract ended. By offering that he got a subleaser pretty quickly. But we also didn't even THINK to show the apartment office his military orders.
We can't afford to split the rent.. We have a 5 month old so a lot of the money goes to things she needs and all my husbands bills. LOL.

I think it's mostly that she doesnt believe me. We couldn't afford to get rings and he and I weren't married when we signed the lease. I don't mind showing it to her but I dont want to have to pay for a copy so I can give it to her.

I didn't think his orders for school was classified. I think he's just being difficult because of how she has been treating us since he's joined. More like me since he hasn't been here.

I'm not sure how much it would cost to get us out. If i leave at the end of this month then we'll still have 5 months left on the lease. But now it's looking like I'll have to pay the rent and only be here for maybe a extra week. he's waiting on our marriage license and our daughters birth certificate to get to him. I don't know how long it takes him to get his mail.
My husband and I went through something like this when we had to move. They told us that I "waited too long" to tell them we were moving and didn't give enough notice ( We moved November 13th, and I had NO clue when the exact date was going to be while he was still in BC...but they had known that we were going to leave sometime in Nov. anyway...it's a looong story!!) so they tried to tell us that we owed them like the next months rent (Dec. even though I had paid Nov. and wasn't staying the whole month) plus however much it was to break the lease, I think like another $200 or something. We pretty much just showed them his orders and basically told them to shove it. We were moving because the Navy told us we were moving not because we didn't feel like living there anymore. About a week ago they sent us a bill for $80. We figured it was easier to just send them the money and be done with it...and hopefully never have to hear from them again.

It seems like your situation is a bit different than mine was and you are dealing with just a single landlord rather than a rental property. I would just guess that you should just have to show her the orders that states that your husband is being moved here. you are his wife and are able to move with him so I would just show her your license but just have her make a copy of it if she's that worried about it. I also think thats pretty silly of her.

If you do come to an agreement and decide to pay her, be sure to write on the bottom to the check "All debts paid in full" that makes the check become a legally binding contract and if she cashes it she agrees to that statement.

Sorry if I didn't really answer any of your questions, just wanted to try to help you out and let you know that I've been there too and know what you are going though a little bit. Maybe we can meet once you get here! Good luck with everything!
Someone feel free to correct me if I am wrong, but I thought they weren't allowed to charge you or penalize you for breaking lease if you got military orders sending you elsewhere. I am not even sure who to check with to verify this.
Yeah Maureen I'm thinking that too - that's why I feel like if she has the orders, that's all she should need.

MaddiesMommy - can you ask your husband to ask his Chief about this? Chiefs are there for this sort of thing, not just for classes :) His chief (or even another one) would be able to answer this with real authority!
