Thanks. And yeah i dnt think that is necessary but he said he will. Idk. But ima kick his ass when i see him. I told him about doing shit like this. Im PISSED right. Now. And if he does pay for the lawyer it will set us back a ton bcuz im supposed to be moving down to San Diego with him in Dec. That money could be used for our down payment,rent, and living. Smh

He will need to pay for a lawyer because it will be a civilian offense he will need to have a good lawyer. If not he could end up having to serve time which could get him in even more trouble. But honestly it depends on the command. He could get kicked out its a very real possibility. He could get 30-90 days restriction if he gets off easy, docked pay, drop rank, attend classes both for Navy and civilian. It will also depend on how many DUIs a command has had recently and if he has had any other issues with his command. If the command has had a lot they may decide to make an example. I am sorry hun. Its a very scary but they are cracking down.

He may need a lawyer, and like Meagan said if he does he will need a VERY good civilian lawyer. In military member DUIs, the military decides whether the military will handle it or whether they will send it to the civilian courts. If it does go to court they go harder on military members. Sad but true. If it doesn't go to court he won't need a lawyer but like the other ladies said, he could very well get separated and even if he doesn't he will have to face some very severe consequences. I'm so sorry I know you must be dealing with some pretty strong emotions right now!

Actual what happens is he gets charged out in town for the DUI, and also goes to CO's mast. It isn't double jeopardy as the Navy gets him for disobeying a lawful order (don't drink and drive).
So either way this young man will get hit twice, once out in town and once by the Navy. Ever Meagan said is true, he could be kicked out with a Dishonorably discharge, or he could just get up to 60 days restriction.
Also if he is allowed to stay in and just goes to CO's mast, he might as well kiss the rest of his career goodby, as when it comes time to reenlist, he has to get approval for that (it is called PTS) and they will see the CO's mast, easy choice if they need to separate someone, they pick those with CO's mast.

I'm sorry, but yes, there is a chance they can kick him out for this, especially if he's within his first 2 years of service. If he's been in longer than that, there's more of a chance the Navy will decide that they have more of an investment in him and not kick him out.
This command and the last 2 we've been at, for a Dui, especially one that involves civilian authorities, the command policy is to throw the book at them. Which means, depending on the CO's rank whether they can order 30 or 45 (they can do 60, but then they can't do extra duty) but odds are, either 30 or 45 days restriction and 30 or 45 days extra duty. Add to that, reduction in paygrade (if he is frocked but not getting paid for it yet, they will go back 2 paygeades - so a frocked E-4 will become an E-2). Half a months pay (depending on the rank of the CO they can take half a month for 2 months). The CO could choose to suspend any part of this punishment, where it's on the books, so if he gets on trouble for anything again then it's reinstated. The classes and counseling is pretty much a given.
Even if they choose to retain him and keep him in the Navy, unless he has over 14 years in, he has to request for permission to re-enlist if he chooses, and a Dui is an almost guaranteed automatic denial.
I'm very very sorry to tell you this, because I know it sounds pretty bleak and serious, but because it is so serious, I think it's better to know what you're facing.
It might be a very good idea if you postpone your moving plans and hang onto that money until you hear what they say.
