My son is currently deployed.   His wfie was staying back with me and other family members the past 4 months.  Unfortunately, she started an affair a month ago and she has admitted it to my son.  My son is devastated and understandable angry.   On top of the misery, she has never worked and has no source of income, but she withdrew all but a few dollars from their account.    My son wants a divorce and won't be back from deployment for several months.  Right now I am trying to help him keep his accounts safe with POA.   Do any of you have any advice from your own kids on serving papers or the procedure of the Navy Legal department?    He tells me he has no where to get answers on the ship.   So sad for them to hit him while he is out at sea.... my heart breaks for him.

This document is from San Diego County and lists all the residency requirements for filing for divorce in their jurisdiction.  Hope it helps - at least in some manner......

Where does he pay state taxes, and where would he be registered to vote? If he never changed it, then his residency is probably still the same as his original home of record. You must make an effort (get the drivers license, register to vote) in order to change state residency. I've done it often enough. Legal could help him figure out that part.
Home of record is where you enlisted, period, and does not have to be where you file for divorce. I was technically a resident of WV, stationed in Japan, when I filed for a California divorce (we were married at the embassy in Tokyo). I just used my SIL's address, the state wanted little else when I picked up the petition for dissolution other than my military ID. The SIL took the final paperwork in for me once I got him to sign it in Japan. It gets complicated.

Thank you again to all.   My son did file his taxes in my home state.  I called the San Diego Courthouse and they said he COULD file there, but does not have to since he in the military and did not pay taxes there, so it looks like that will make it easier.  According to the legal advice he got on the ship, he does not need to pay her the monthly support at this time since she currently took several months of pay already.  They said that if he is told to pay it to her, then he just needs to do that with no punishment.

Do they have children together?

yes, he filed in my state, so thanks, we have that figured out.   Fortunately they did not have any children.

So sorry your son had to go through a divorce.     He is going to make sure he has the money put aside.   That is one thing about deployment - he is saving up money and not spending it!   They had no loans to pay, thank goodness.   Thanks.
