Hello All,

I have seen quite a few posts on this subject but I'm not quite sure of what I'm looking for.  Here's the deal, my son is a Seabee.  Has about 3 weeks left of A school.  Well, he and 8 other Sailors went out on Liberty to Hooters.  Needless to say, when they came back they had all been drinking and were caught on tape.  He immediately called home to tell me that he was being charged with 3 articles- one for drinking underage, one for drinking before he had duty (16 hours later) and one for contributing to the deliquency of a minor.  The last one is based on some girl saying he bought her a drink.  Anyway, he's already went to one meeting with the CO, now he's set for XIO (?) and convinced its going to Captains Mast.  Theyve already advised him he's looking at 45 days restriction and loss of pay (1/2 x 2) but he's worried they will kick him out of his Seabee job.  Which frankly so am I.. He's in the top 10 of his class and never been in trouble the whole time.  What should I expect?  I have a retired friend who is a Master Chief and he says not to hire an attorney as that will turn it into a Court Martial.  What factors are taken into consideration upon punishment?  He's relatively new so he shouldnt have a whole lot in his file to substantiate character-either good or bad....I guess Im just trying to get a step ahead of him so I can react accordingly when that call comes in....

He's ready to take his "lumps" no doubt. He knows if you do the crime you do the time. Its me thats worried about the time....Hard to adjust to not being in the loop with his "life" anymore-if you know what I mean. Thanks for the info I appreciate it!
Oh my Sailor knows he did wrong. He was telling me he'd be willing to do 1/2 pay x4 and extra duty and so on. He trusts the Master Chief he talked to so he wouldnt dare appeal it. I just kind of needed a heads up as to how this potentially plays out. Punishment is warranted he just would prefer not to lose his job...He's figured out that although hes young-hes not invincable....Tough lesson but it will stick him Im sure..Thanks for the info!
my son is currently in a similar situation  can you tell me what his punishment was?  did he get kicked out?
The one thing you need to be aware of is that it is now in his file and if he should have a 2nd offense with alchol involved he would for sure be kicked out of the Navy.

Hi there-sorry so long to reply... My son went all the way to Captains Mast.  They gave him 45 days restriction and half months pay x2.  He was not kicked out.  I have heard of sailors getting tossed but mine was not.  I do not know this for fact but I think 45 days restriction is fairly common for a first offense.  Im sure there is a TON of other factors that look at in determining punishment but I know a few sailors that got 45/45 for their first offense on alcohol related incidents.  The Navy just doesnt tolerate it anymore.  This was tough on me because I couldnt help in any way but he learned from it.  He's not willing to throw his career away for alcohol.  If you have any other questions, just message me-I'll try to help!

With all the changes to the USN, he better have 3 plans...1 for if he gets kicked out (which yes can happen), 2 for if he gets to stay...and how is he is going to prove he is worthy of keeping (as there are many programs now that review sailors careers and things they did 5 years ago can make it so they are not allowed to stay in the USN) and 3....a plan for when he is told he has to go home.  Yes...I said when...any little mistake that someone makes if it goes on their record it will prevent them up to 5 years down the road from being able to reenlsit in the USN.
