In our case it was the ex that tried "beating us to the punch" and so when we filed, we were told that the daughter was already claimed and filed.  We told them that we had proof we had the right and then after much filling of forms and hassle, we finally got our return back and she ended up getting a call directly from IRS and they told her that if she ever tried that again they would press charges (or something).  She ended up having to pay back all of the money that they paid her plus penalties and fees.  Think they scared her straight as we didn't have any other issues with her after that.

Civilian taxpayers covered by the relief provisions described here should put the words "COMBAT ZONE" and their deployment date in red at the top of their tax returns. Members of the military do not need to write "COMBAT ZONE" and their deployment date on the tops of their tax returns because the U.S. Department of Defense informs the IRS about members in the combat zone.

Mrs. Andy, that can backfire on you quite quickly especially if you have papers that show you are to claim every other year.  My husband's ex tried that only ONCE ... don't think she will try it again as they went after her big time!!!  I like what Dor did ... and we will try it both ways and work with our son on it even though he did live with us more than 6 months this past year.

If you have access to his MyPay site, the instructions for the W-2's are there. Go to his W-2 and in the boxes on top click on center bottom row COPY B-C BACK I think is the button for the instructions. I've done taxes for years and your son doesn't need to submit a copy of his orders.

hey, so i know we were talking earlier about a place on base that will do their taxes for free. Any word on where that place is?

I realize that I might be misunderstood.  When I said that "if he and your son worked together" I really meant that they come to a decision to either claim him or not claim him ... working it out, so to speak.  Sorry if it sounded like something else.

If your son lived with his dad for more than half of the year, he is eligible to claim him on his taxes.   The only way that would change would be if he and your son worked together.  Your son, when filing his taxes, will be asked if he has been claimed on another person's taxes, if he says YES, then he has to mark that.  If he says NO, and if dad claims him as well ... someone will be getting a letter from the IRS.

Now the accountant says she needs a copy of my son's orders, which would show he is active duty and being paid outside the state of Penna. How on earth do I get a copy of his orders? Don't want to bug him 'cause he has comps on Monday to finish up A school. Geez, never dreamed this would be so complicated!

Dor and Kat, thanks ... I got your replies and right away called the accountant back and she asked, is he active duty? Kind of threw me ... I said, of course, since Day One of boot camp. Right?? Active duty doesn't mean combat, I should think, so yes, our sailors in nuke school are active duty.She said the W2 should have reflected active duty status. Hmmm.
